1. Website owner

In compliance with Article 10 of Spanish Law 34/2002 on Information Society Services (LSSI-CE), this website (https://dulcefragancia.officetools.es) is owned by Adriel Benjamín Muralla Parada, NIE Z1813604J, a self-employed trader operating under the trade name Dulce Fragancia, engaged in the retail sale of perfumery and cosmetics products, with premises at C/ del Marqués de Comillas, 39, 03501 Benidorm, Alicante. 2. Purpose and acceptance

These terms govern the purchase of products through the Dulce Fragancia online shop. By placing an order, the customer declares to be of legal age, to have the legal capacity to enter into contracts, and to have read and accepted these terms, the privacy policy and the cookie policy. The contract is concluded in Spanish.

3. Products and prices

Fragrances and other products are described as accurately as possible; images are for guidance and slight differences in presentation may exist. All prices are shown in euros and include applicable VAT. Shipping costs, if any, are always shown before you confirm payment. Orders are subject to availability: if a product cannot be supplied, we will let you know and refund any amount already paid.

4. Purchase process and payment

To buy, simply add products to the cart, enter your delivery details and pay. You can buy with an account or as a guest. Card payments are processed by Stripe on its own secure page: this shop neither receives nor stores your card details. The order is confirmed once payment is completed and we send you the confirmation email; until then you can correct or abandon the purchase without any commitment.

5. Delivery

• Pick-up in store, free of charge, at C/ del Marqués de Comillas, 39, 03501 Benidorm, Alicante (Todos los días, 10:00–21:00). We will let you know when your order is ready.
• Home delivery within Spain: €4.95 per order, free for purchases of €60.00 or more. Estimated delivery time: 2 to 5 working days from payment confirmation, barring causes beyond our control. In any case, we will deliver the order within 30 calendar days of the conclusion of the contract (Art. 66 bis TRLGDCU).

Check the parcel on receipt and, if it arrives damaged, note it on the delivery slip or write to us within 48 hours with photographs.

6. Right of withdrawal

As a consumer you have the right to withdraw from the contract within 14 calendar days without giving any reason, counted from the day you (or a third party you designate) receive the products (Arts. 68 et seq. of Royal Legislative Decree 1/2007, TRLGDCU). To exercise it, notify us unequivocally by email at dulcefraganciaperfum@gmail.com stating your name, order number and your decision to withdraw. You have a further 14 calendar days to return the products.

• The product must be returned in perfect condition, in its original packaging and not used beyond what is necessary to establish its nature.
• The direct costs of returning the goods are borne by the customer.
• We will refund all payments, including the standard delivery costs of the initial shipment, within 14 calendar days of you informing us of your decision, and may withhold the refund until we receive the products or proof of their dispatch. The refund is made using the same payment method.
• You are liable for any diminished value of the product resulting from handling other than what is necessary to establish its nature and functioning.
• The right of withdrawal does not apply to sealed products that are unsuitable for return for health-protection or hygiene reasons and that were unsealed after delivery (Art. 103 TRLGDCU) — for example, an opened or tested perfume or cosmetic product — nor to customised products.

7. Legal guarantee and defective products

Products carry the legal guarantee of conformity of 3 years from delivery (Arts. 114 et seq. TRLGDCU). If you receive a product that does not match your order or is not in conformity, you are entitled to have it repaired or replaced or, if that is not possible, to a price reduction or termination of the contract, at no cost to you. Write to us at dulcefraganciaperfum@gmail.com with your order number and, if possible, photographs.

8. Use of fragrances and liability

Fragrances are cosmetic products for external use only. Before use, check the ingredient list on the packaging and avoid contact with eyes and mucous membranes; stop using the product if irritation occurs. Keep out of the reach of children. Dulce Fragancia is not liable for damage resulting from use contrary to these instructions, without prejudice to the liability imposed by law in any event.

9. Intellectual property

The texts, images, logo, brand and design of this site belong to its owner or are used under licence, and may not be reproduced, distributed or altered without express authorisation. Third-party trademarks mentioned belong to their respective owners.

10. Customer service and complaints

You can contact us at dulcefraganciaperfum@gmail.com, by phone on +34 613 23 46 95 or at our shop at C/ del Marqués de Comillas, 39, 03501 Benidorm, Alicante, where complaint forms are available. We will try to resolve any issue amicably. You can also turn to the consumer services of your autonomous community or to an alternative dispute resolution body for consumer matters.

11. Data protection

The processing of your personal data is governed by our privacy policy, in accordance with the GDPR and Spanish Organic Law 3/2018 (LOPDGDD).

12. Governing law and jurisdiction

These terms are governed by Spanish law. If you are a consumer, disputes will be submitted to the courts of your place of residence, in accordance with applicable consumer legislation.

13. Changes

We may update these terms; they will apply to orders placed after their publication on this page with the date of the last update. Orders already confirmed are governed by the terms in force at the time of purchase.
